THE BRICK GRANBY ANNIVERSARY CONTEST

1. GENERAL

- The contest shall be conducted by The Brick Warehouse LP (“The Brick”) exclusively at The Brick’s Granby store at 40 rue Evangeline, Granby, QC, (hereinafter referred to as “Store”). A participant shall be referred to as “You” or “Your”.

Ways to enter:

If You finalize a sale of product purchased at The Brick Granby during the Contest Period, using any payment method, You will be automatically entered to win a prize on the Draw Date.

No purchase necessary methods of entry:

To enter, You must attend the Store to scan the exclusive contest QR code. A sales associate will direct You to a QR code that will take You to the online entry ballots. You must complete and submit the online entry (both the automatic entries and on-line entries will collectively be referred to as “Entry/Entries”)

Limit of one (1) on-line Entry per family per day. To enter, You must live within the Granby postal code region and/or within fifty (50) km of the Store address.

For this purpose, “family” means all persons, whether related or not, living in the same household who are over the age of majority in the province in which they reside. The use of any device to automate the entry process is prohibited. Any attempt to manipulate the Contest will result in You being disqualified.

Contest dates: Commencing Tuesday, September 20, 2022 at 9:30 a.m. EST, until the close of business on Monday, September 26, 2022 at 5:30 p.m. EST (“Contest Period”)

“Draw Date” – Tuesday, September 27, 2022 at 11:00 a.m. EST

Odds of winning decrease as the number of purchases made, or Entries submitted, increase during the Contest Period.

2. GRAND PRIZE

There is one (1) prize to be won, listed below.

Grand Prize: Springwall Pisa Eurotop Queen Mattress Set; PISAETQP; Retail $899.00

Prize must be accepted as awarded, may not be sold or transferred and is not convertible to cash. Prizes are non-transferable, non-exchangeable, and non-refundable.

Once the Winner has been confirmed, the Store will arrange for delivery of the Prize to the Winner living within 50 km of a Brick store. Should the Prize Winner live outside of the specified delivery area, The Brick will ship the Prize to the Distribution Centre/Store closest to them.

The Brick’s Satisfaction Guarantee, Price Guarantee and Price Protection policies as published from time to time shall not be applicable to any merchandise obtained as a result of redeeming the Brick Gift Card or any portion thereof. The Brick’s liability for defective merchandise shall be limited to repairing defective or, where appropriate, to exchanging such defective goods within the manufacturer’s warranty period and in accordance with such warranties. In no case shall The Brick refund or otherwise compensate the winner beyond repairing or exchanging defective goods

3. ELIGIBILITY

The contest is open to Quebec residents who:

1. live in the postal code region of Granby and/or within fifty (50) km of the Store address who have reached the age of majority on or before the commencement of the Contest Period, except employees of The Brick and their immediate family members living in the same household;
2. have made a purchase at the Store during the Contest Dates OR have complied with the NPM Entry;
3. agree to abide by the contest rules as set out herein, subject to all federal, provincial and municipal laws.

It is a condition of eligibility that the Winner authorizes The Brick to announce and publish his/her name, address and photograph, without remuneration or consideration, in any forthcoming publicity.

4. DRAW DATES AND PROCEDURES FOR DETERMINING WINNER

On the Draw Date, a representative from the Store will draw and record two (2) Entry Forms to obtain one (1) winner (“Eligible Winner”). The additional entry drawn is a back-up entry in the event that the initial Eligible Winner is non-responsive after contact, fails to comply with the Contest Rules, or is unable to complete the skill-testing question (“Alternate Winner”).

The Brick representative will use his/her reasonable efforts to contact the Eligible Winner by phone or e-mail after the Draw Date. If the Eligible Winner cannot be reached by telephone or has not contacted The Brick within three (3) days of The Brick leaving messages to do so (“Contact Date”), then that person will be disqualified, and The Brick shall proceed to contact the Alternate Winner.

5. DECLARING WINNER

The Eligible Winner whose entry form has been selected on the Draw Date must:

1. Be over the age of majority in the province in Quebec;
2. within three (3) business days following the Contact Date, correctly answer a time limited, arithmetical skill-testing question without the assistance of any person or mechanical/recording device(s). The skill-testing process shall be administered at a pre arranged time and place; and
3. execute a declaration and release form confirming compliance with the contest rules and acceptance of the Prize.

Should the Eligible Winner fail to answer the skill-testing question correctly or is unable to attend at the time and place designated by the Store for the administration of same, the Eligible Winner shall be disqualified, and the skill-testing question shall be administered to the Alternate Winner. By accepting the Prize, the Winner agrees to The Brick’s use of their names, city, province or territory of residence and/or photograph for advertising and publicity purposes without compensation.

6. ADDITIONAL TERMS

By participating, You agree that: a) these Official Contest Rules and The Brick’s records of the draw or any other aspect of this contest shall be final and conclusive in all respects; and b) release, discharge, indemnify and hold harmless The Brick and its trustees, directors, officers, and employees from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.

7. LIMITATION OF LIABILITY

The Brick shall not be responsible for print or typographical errors in any Contest-related materials; for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction. The Brick assumes no responsibility for any computer, online, software, servers, providers, computer equipment, hardware or technical malfunctions that may affect the transmission or non-transmission of an Entry.

8. PRIVACY POLICY:

The Brick will use the contact information provided in contest entries for administration of this Contest and/or to ascertain Your needs and market to You. We may communicate with You for any of these purposes by telephone, fax, text messaging, or other electronic means, and automatic dialing-announcing device, at the numbers You have provided us, or by internet, mail, email and other methods. By entering this Contest, You acknowledge and agree to give permission to The Brick to collect, use and disclose Your personal information in accordance with The Brick’s privacy policy (“Privacy Policy”). The Brick is committed to protecting the privacy of the personal information You have provided herein. 9. PRIVACY POLICY

For Québec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

• The Brick reserves the right to amend or vary the Official Contest Rules, including the imposition or addition of new rules which are deemed by The Brick in its sole discretion necessary for business efficacy.

• The Brick’s records of the draw or any other aspect of this Contest shall be final and conclusive for all purposes relating to this Contest.
